These Terms of Service ("Terms") govern your use of TextBoss, an SMS-based AI operations assistant provided by Twoby2 Studios LLC ("TextBoss," "we," "us," or "our"). By using the Service, you agree to these Terms.

1. Program description

Program name: TextBoss.

TextBoss is a two-way SMS service that helps small service-business operators manage their business operations — including appointment booking, quote delivery, service reminders, and customer inquiries — through text messages. Messages may be sent or received between a business operator and the Service, or between a business operator's customers and the Service on behalf of the operator.

2. Eligibility

You must be at least 18 years old and authorized to enter into these Terms on behalf of yourself or your business to use the Service.

3. SMS program terms

• Opt-in: by providing your phone number and enrolling in the Service, you consent to receive SMS messages from TextBoss related to your business account and operations.
• Opt-out: you can opt out of SMS messages at any time by replying STOP to any message. You will receive a confirmation of your opt-out.
• Help: reply HELP to any message to receive support contact information.
• Carriers: carriers are not liable for delayed or undelivered messages.
• Supported carriers: the Service supports major U.S. carriers including AT&T, T-Mobile, Verizon, and others. Availability may vary by carrier.
• Message and data rates: standard message and data rates from your mobile carrier may apply to messages sent to or from the Service.

4. Account and access

You are responsible for the accuracy of information you provide, for activity conducted through your account, and for maintaining the confidentiality of any credentials associated with your account. You must notify us promptly of any unauthorized use.

5. Acceptable use

You agree not to use the Service to:

• Send unsolicited commercial messages, spam, or content that violates the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or CTIA guidelines.
• Send content that is unlawful, fraudulent, harassing, threatening, obscene, or otherwise objectionable.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Attempt to probe, scan, or test the vulnerability of the Service, or breach security or authentication measures.
• Interfere with or disrupt the Service or servers or networks connected to the Service.

6. AI-generated content

The Service uses artificial intelligence to generate message content and suggestions. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and approving communications sent on your behalf. We are not responsible for business decisions made based on AI-generated content.

7. Fees and billing

Fees for the Service, if any, will be communicated at the time of signup or through your account. All fees are non-refundable except as required by law. We may change fees with reasonable advance notice.

8. Termination

You may stop using the Service at any time by replying STOP or contacting support. We may suspend or terminate your access for violation of these Terms, non-payment, or legal or operational reasons. Upon termination, you may request deletion of your data.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

To the maximum extent permitted by law, Twoby2 Studios LLC and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or in connection with the Service. Our total liability for any claim arising under these Terms is limited to the greater of fees you paid to us in the 12 months preceding the claim or $100.

11. Indemnification

You agree to indemnify and hold Twoby2 Studios LLC harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in North Carolina.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance.
